Terms and Conditions

These terms and conditions govern the relationship between LYMU s.r.o., with its registered office at Nové sady 988/2, Brno, 602 00, entered in the Commercial Register kept by the Regional Court in Brno, section C, file 141178 (hereinafter referred to as the "Seller") and the Buyer in connection with the purchase of goods through the Seller's online store at lymu.co (hereinafter referred to as the "e-shop").

1. Definition of terms

Seller: LYMU s.r.o.

E-shop: lymu.co

Buyer: fyzická nebo právnická osoba

Goods: veškeré produkty nabízené k prodeji v e-shopu, včetně produktů značky LYMU.

Purchase agreement: a contract concluded between a seller and a buyer, the subject of which is the purchase and sale of goods.

2. Conclusion of the purchase contract

2.1 The purchase contract is concluded when the seller confirms the buyer's order. The order is a proposal for a purchase contract by the buyer. Confirmation of the order is the acceptance of the proposal by the seller.

2.2 The buyer may cancel the order until the notification of acceptance of the order is received by the seller via e-mail info@lymu.co, where the order number must be indicated.

2.3 In the event that, as a result of a technical error on the part of the seller, the price of the goods in the e-shop or during the ordering process is clearly incorrect, the seller is not obliged to deliver the goods to the buyer at the incorrect price and change the order.

2.4 The amended offer is considered a new draft purchase contract, which in such a case is concluded by confirmation of acceptance by the buyer to the seller's email address.

3. User account

3.1 After the first order, the buyer will gain access to a user account where they can manage their orders and track the delivery status.

3.2 The buyer enters the user account based on the email address to which he will be sent a code with which he logs into the user account. This process is repeated with each subsequent login.

3.3 By accessing the user account, the buyer gains insight into the history of their orders and delivery details.

3.4 When modifying or setting all data, the buyer is obliged to provide true and complete information.

3.5 The buyer is responsible for all activity that occurs under their account.

3.6 In the event of loss or misuse of the account, the buyer is obliged to immediately inform the seller.

3.7 The Seller reserves the right to cancel the user account in the event of a violation of these terms and conditions by the Buyer.

4. Goods and prices

4.1 All goods offered in the e-shop are provided with a description that contains information about their properties and method of use.

4.2 The prices of goods listed in the e-shop are final and include VAT. LYMU s.r.o. is not a VAT payer.

4.3 Promotional prices and discounts cannot be combined with each other unless expressly stated otherwise in the e-shop.

4.4 The seller reserves the right to change the prices of goods. New prices will be valid from the moment they are published in the e-shop. The price change does not apply to already confirmed orders.

5. Payment terms

5.1 The buyer can pay for the goods cashlessly through the Shopify Payments payment platform, which offers online payment using Visa, Mastercard, Maestro, Google Pay, and Apple Pay.

5.2 A non-cash payment is considered to have been made and the buyer's obligation to pay the purchase price fulfilled at the moment the relevant amount is credited to the seller's bank account.

5.3 When choosing cash on delivery, the buyer is obliged to accept and pay for the order based on the concluded purchase contract. The seller has the right to recover from the buyer any damage incurred due to shipping and packaging costs.

5.4 Available payment methods may vary depending on the buyer's country.

6. Delivery terms

6.1 Goods are delivered within some countries of the European Union.

6.2 The seller ships the goods without undue delay after the buyer pays the purchase price and the payment is credited to the seller's bank account.

6.3 The seller has the right to set the delivery location if it has not been set by the buyer according to the instructions and within the specified period after completing the order.

6.4 The primary delivery service for goods from the Czech Republic is Packeta. The seller reserves the right to use other delivery services.

6.5 Delivery costs vary depending on the selected shipping method and country of destination. The specific shipping price is stated in the order.

6.6 The delivery time is only indicative and the seller does not guarantee its compliance.

6.7 The delivery person is responsible for any damage to the goods during transport. The buyer is obliged to check the shipment upon receipt and, in the event of damage, draw up a damage report with the delivery person.

6.8 The seller does not allow personal collection of goods purchased through the e-shop.

7. Withdrawal from the contract

7.1 Detailed conditions for withdrawal from the contract can be found on the Return and Refund Policy page.

7.2 The buyer has the right to withdraw from the purchase contract without giving a reason within 14 days of receiving the goods.

7.3 To withdraw from the contract, the buyer can use the form that can be downloaded via the withdrawal from the purchase contract link and send it to the e-mail address info@lymu.co.

7.4 In the event of withdrawal from the contract, the buyer is obliged to return the goods undamaged and unworn within 14 days, if possible in the original packaging, to the seller's address by registered mail delivered in person.

7.5 The buyer may be required to pay compensation for the reduction in the value of the goods only in cases where the goods were handled regardless of their properties and nature.

7.6 The costs associated with withdrawal from the contract are borne by the buyer.

8. Complaint

8.1 All conditions and procedures in the event of a complaint about goods are governed by the Complaints Code.

8.2 The buyer has the right to claim the goods in accordance with applicable legal regulations.

8.3 To make a complaint, the buyer can use the form available for download via the link Complaint form.

8.4 The complaint will be handled as soon as possible, but no later than 30 days from its submission.

9. Return of goods

10. Out-of-court dispute resolution

In the event of a dispute between the seller and the buyer, the buyer may use the online out-of-court dispute resolution platform available on the European Union website.

11. Final provisions

These terms and conditions are valid and effective from November 19, 2024. The Seller reserves the right to change the terms and conditions.
